PROVISIONS
Article 80: In the disciplinary review of the party organization, party members who have the obligation to testify in accordance with laws and regulations refuse to testify or deliberately provide false information. If the circumstances are serious, they shall be given a warning or a serious warning; if the circumstances are serious, they shall be removed from their positions in the party. Interpretation
Article 80 of the "Regulations" adds new provisions on the punishment of party members who have the obligation to testify in accordance with laws and regulations in the disciplinary review of party organizations for refusing to testify or deliberately providing false information. Disciplinary review is a serious political work and an important measure to maintain the party's disciplinary authority. The "Regulations on the Inspection of Cases by the Disciplinary Inspection Organs of the Communist Party of China" issued in 1994 and its implementation rules clearly stipulate that "all organizations and individuals who know the circumstances of the case have the obligation to provide evidence", "Party members refuse to testify or deliberately provide false information, and the circumstances are serious. Those who should be given party disciplinary sanctions in accordance with relevant regulations." This requirement is consistent. Article 18 of the "Supervision Law" and Article 42 of the "Administrative Punishment Law" stipulate that supervisory agencies have the right to learn about the situation from relevant units and individuals in accordance with the law, collect and obtain evidence, and relevant units and individuals shall truthfully provide information. When a case is reviewed, many witnesses are often involved. Although these witnesses are not the parties or persons involved in the case, they have the obligation to testify in accordance with laws and regulations because they know the relevant circumstances of the case. Party members who are witnesses should strengthen their organizational concept and awareness when they are organized to learn about the relevant situation from themselves. In line with the attitude of being highly responsible for the party's comrades, party organizations and the party's cause, they should objectively and truthfully reflect the situation, seriously perform the obligation to testify, and jointly safeguard the authority and seriousness of the disciplinary review work.
